1. Acceptance of Terms

By accessing and using englishspeakingjobs.de ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Service Description

englishspeakingjobs.de is a job board platform that connects job seekers with employers offering English-speaking positions in Germany. The Service includes:

  • Job listings and search functionality (including aggregated third-party listings)
  • Application tracking tools
  • Profile optimization services (AI-powered)
  • Employer job posting services
  • Communication between job seekers and employers

3. Third-Party Job Listings & Aggregation

Our platform aggregates and displays job listings from third-party applicant tracking systems (e.g., Greenhouse, Lever) and external company career pages.

  • No Ownership: We do not own, create, or control these third-party job listings.
  • No Guarantee: We do not guarantee the accuracy, completeness, or current availability of these external job postings.
  • External Links: Clicking "Apply" on an aggregated job may redirect you to an external website. We are not responsible for the content, privacy practices, or hiring processes of these external sites.

4. User Accounts

4.1 Account Creation

To use certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4.2 Account Types

Job Seekers: Free accounts for browsing jobs and applying to positions

Employers: Paid accounts for posting jobs and accessing applicant profiles

5. User Conduct

You agree NOT to:

  • Post false, misleading, or fraudulent job listings or applications
  • Use the Service for any illegal purpose
  • Harass, abuse, or harm other users
  • Scrape, copy, or download content without permission
  • Reverse engineer or attempt to access source code
  • Upload viruses, malware, or malicious code
  • Impersonate any person or entity
  • Spam users with unsolicited communications
  • Discriminate based on race, gender, religion, nationality, disability, age, or other protected characteristics
  • Post content that violates intellectual property rights

6. Job Seekers

6.1 Application Process

When applying for jobs:

  • You authorize us to share your profile and application materials with employers
  • You represent that all information provided is truthful and accurate
  • You understand we are not responsible for hiring decisions
  • You accept that employers may contact you directly

6.2 Profile & CV

You retain ownership of your profile and CV content. By uploading, you grant us a non-exclusive license to display, store, and share this content with potential employers.

7. Employers

7.1 Job Postings

Employers agree to:

  • Post only legitimate job openings for actual positions
  • Provide accurate job descriptions, requirements, and compensation
  • Comply with all applicable employment and anti-discrimination laws
  • Not use job postings for competitive intelligence or data harvesting
  • Not collect applicant data for purposes other than hiring

7.2 Pricing & Payment

Job Posting Fees: Pricing and any applicable taxes/fees are shown before purchase.

Payment is required before job postings go live. Fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice.

7.3 Visa Support Claims

If marking a position as "Visa Supported," you confirm that your company is willing and able to sponsor work visas for qualified international candidates.

8. Intellectual Property

The Service, including its design, logos, text, graphics, and code, is owned by Guiding Ventures and protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works without our written permission.

9. AI Services & Third-Party Tools

We use Google Gemini AI to provide profile optimization services. By using AI features:

  • You consent to your data being processed by Google's AI services
  • You understand AI suggestions are automated and may not be perfect
  • You are responsible for reviewing and editing AI-generated content
  • You acknowledge that AI results are not guaranteed to improve outcomes

10. Disclaimers & Limitations of Liability

10.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Guarantee of Results

We do not guarantee:

  • Job seekers will find employment
  • Employers will find qualified candidates
  • The accuracy of user-submitted content
  • Uninterrupted or error-free service operation

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUIDING VENTURES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid us in the past 12 months, or €100, whichever is greater.

Mandatory exceptions: The above limitations do not apply to (a) damages from injury to life, body, or health; (b) damages caused by gross negligence or intentional misconduct by Guiding Ventures or its representatives or agents; (c) liability under mandatory statutory provisions (including the German Product Liability Act). These exceptions cannot be contractually limited.

11. Privacy & Data Protection

Our Privacy Policy (available separately) explains how we collect, use, and protect your personal data in compliance with GDPR. By using the Service, you agree to our Privacy Policy.

12. Termination

We may suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or for any other reason at our discretion.

You may delete your account at any time through your account settings or by contacting us.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or a prominent notice on the Service.

Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.
